Controlled Dangerous Substance (CDS) Stock Destruction – New Jersey Sample

Purpose

To establish a standardized process for the destruction of Controlled Dangerous Substance (CDS) stock in compliance with New Jersey Drug Control Unit requirements, DEA requirements, facility policy, and applicable accreditation standards.


Policy

Expired, damaged, contaminated, discontinued, unusable, or unwanted Controlled Dangerous Substance (CDS) stock shall remain secured and accounted for until destruction is authorized and completed.

Prior to destruction, the facility shall obtain authorization through the New Jersey Controlled Dangerous Substance Destruction Request process (DDC-51).

DEA Form 41 shall be completed as the official federal destruction record documenting destruction of controlled substances.

All CDS destruction shall follow the facility’s Controlled Substance Destruction Policy and shall utilize a destruction process that renders the controlled substance non-retrievable.

Whenever feasible, destruction should be completed using a Drug Buster® disposal system or equivalent approved destruction system capable of rendering medications non-retrievable.

No CDS stock shall be destroyed prior to required approvals.


Procedure

1. Identify CDS for Destruction

Identify CDS stock requiring destruction, including:

  • Expired medications

  • Discontinued medications

  • Damaged medications

  • Contaminated medications

  • Unusable inventory

  • Unwanted stock


2. Secure Controlled Substances

Maintain CDS inventory awaiting destruction in approved secured storage with restricted access.

Inventory shall remain reconciled and secured until destruction is completed.


3. Reconcile Inventory

Prior to destruction:

Verify:

  • Perpetual inventory

  • Receiving documentation

  • Administration records

  • Controlled substance logs

  • Physical inventory count

Document reconciliation prior to destruction.

Any discrepancy shall be investigated before proceeding.


Complete all required portions of the New Jersey destruction request form.

Include:

  • Facility information

  • NJ CDS registration number

  • DEA registration number

  • Contact information

  • Medication name

  • Strength

  • Dosage form

  • Quantity to be destroyed

  • Reason for destruction

Review for completeness before submission.


5. Submit DDC-51 and Obtain Authorization

Submit DDC-51 to the New Jersey Drug Control Unit.

Do not proceed with destruction until authorization is received.

Only destroy approved medications and approved quantities.

Document authorization information.


Complete DEA Form 41 to document controlled substance destruction.

Include:

  • Registrant information

  • DEA registration number

  • Drug information

  • Strength and dosage form

  • Quantity destroyed

  • Date of destruction

  • Location of destruction

  • Method of destruction

  • Witness information and signatures

DEA Form 41 serves as the facility’s official destruction record.


7. Perform Destruction

Once authorization has been obtained and DEA Form 41 has been completed, destroy CDS stock in accordance with the facility’s Controlled Substance Destruction Policy and Procedure.


Destruction must render the controlled substance non-retrievable, meaning permanently altered so that it cannot be transformed, reclaimed, extracted, or made available for future use.


Whenever possible, CDS should be disposed of using a Drug Buster® container or other facility-approved destruction system designed to render medications non-retrievable.

Acceptable destruction methods may include:

  • Drug Buster® disposal systems

  • DEA-compliant destruction containers

  • Reverse distributor processes (if permitted by facility policy)

  • Other approved destruction methods meeting DEA non-retrievable requirements

Personnel performing destruction shall:

  • Follow facility destruction procedures

  • Follow manufacturer instructions

  • Wear appropriate PPE

  • Ensure destruction is witnessed by authorized personnel

  • Document date, quantity, method, and witnesses

  • Update perpetual inventory and destruction records immediately

Controlled substances shall never be discarded into regular trash, unsecured waste streams, or disposed of by prohibited methods.


8. File and Retain DEA Form 41

After destruction is completed:

  • Obtain required witness signatures.

  • Attach DEA Form 41 to the approved DDC-51 documentation.

  • Attach inventory reconciliation records.

  • Remove destroyed inventory from perpetual inventory records.

  • File all documentation in the facility’s Controlled Substance Destruction Binder/File.


DEA Form 41 is generally retained on-site and serves as the official destruction documentation.

Records shall be readily retrievable during:

  • DEA inspection

  • New Jersey Drug Control Unit inspection

  • CMS survey

  • Accreditation surveys


9. Record Retention

Maintain:

  • Approved DDC-51

  • Completed DEA Form 41

  • Inventory reconciliation

  • Witness documentation

  • Destruction logs

  • Supporting destruction records

Records shall be retained for a minimum of two (2) years or longer if required by facility policy or accreditation standards.


Responsibility

The Administrator, Director of Nursing, Pharmacist Consultant, Medical Director, and designated licensed personnel are responsible for ensuring destruction is performed in compliance with DEA requirements, New Jersey requirements, and facility policy.


Compliance Statement

Failure to obtain authorization, complete and retain DEA Form 41, document destruction appropriately, follow facility destruction procedures, or maintain records may result in regulatory noncompliance and survey deficiency.
